By accessing or using SmileReach Dentist ("the Platform", "we", "us", or "our"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access the Platform.

SmileReach Dentist is a comprehensive dental practice management platform that provides appointment scheduling, patient management, treatment records, and related services to dental clinics and their patients.

2. Use of Service

You must be at least 18 years old to use this Platform. By using SmileReach Dentist, you represent and warrant that you meet this age requirement.

2.2 Account Registration

When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Promptly update any information to keep it accurate and current
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

2.3 User Types

The Platform serves different user types:

• Clinic Administrators: Dental practices that subscribe to manage their practice
• Clinic Staff: Dentists, receptionists, and staff members with assigned roles
• Patients: Individuals booking appointments and accessing their records

3. Subscription Plans and Billing

3.1 Plan Types

We offer multiple subscription tiers including Free, Starter, Professional, and Enterprise plans. Each plan has specific features, limitations, and pricing as detailed on our pricing page.

3.2 Billing and Payments

• Subscription fees are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by law
• We reserve the right to modify pricing with 30 days notice
• Failed payments may result in service suspension or termination
• You are responsible for all applicable taxes

3.3 Free Trial and Free Plan

Free plans are subject to usage limits. We reserve the right to modify or discontinue free plans at any time with reasonable notice.

4. Acceptable Use

4.1 Prohibited Activities

You agree NOT to:

• Violate the privacy rights of others

Dental clinics using our Platform must comply with all applicable healthcare regulations, including but not limited to HIPAA (in the US), GDPR (in Europe), and local healthcare privacy laws. You are responsible for obtaining proper patient consent and maintaining compliance.

5. Data and Privacy

5.1 Data Ownership

You retain all rights to your data. We claim no intellectual property rights over the material you provide to the Platform.

5.2 Data Security

We implement industry-standard security measures to protect your data. However, no method of transmission over the Internet is 100% secure. You acknowledge that you provide data at your own risk.

5.3 Data Backup and Export

We provide data export functionality. You are responsible for maintaining your own backups. We are not responsible for data loss except as required by law.

6. Intellectual Property

6.1 Platform Ownership

The Platform, including its original content, features, and functionality, is owned by SmileReach Dentist and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Platform for its intended purpose during your subscription period.

6.3 Trademarks

"SmileReach Dentist" and associated logos are trademarks. You may not use these trademarks without our prior written consent.

7. Third-Party Services

The Platform may integrate with third-party services (payment processors, communication services, analytics, etc.). Your use of these services is subject to their respective terms and conditions. We are not responsible for third-party services.

8. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Platform will be uninterrupted, secure, or error-free
• Defects will be corrected
• The Platform is free of viruses or harmful components
• Results obtained from use will be accurate or reliable

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMILEREACH DENTIST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless SmileReach Dentist and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of applicable laws or regulations

11. Termination

11.1 By You

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period.

11.2 By Us

We may suspend or terminate your account immediately, without prior notice, if you breach these Terms or engage in fraudulent, abusive, or illegal activity.

11.3 Effect of Termination

Upon termination, your right to use the Platform will immediately cease. We will provide reasonable time to export your data. Data may be deleted after account closure in accordance with our data retention policy.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Platform. Continued use after changes constitutes acceptance of the new Terms.
